Spectre's Computer Repair Terms of Service

These Terms of Service ("Agreement") govern all diagnostics, repair services, software services, customer portal access, repair tracking systems, website usage, electronic communications, payment systems, and related technology services provided by Spectre Computer Repair ("Company," "we," "our," or "us").

By submitting a device for service, accessing our website, using our customer portal, communicating with our systems, or utilizing any services provided by Spectre Computer Repair, you ("Customer," "you," or "your") acknowledge that you have read, understood, and agreed to these Terms of Service.

WE DO NOT SELL, TRADE, RENT, OR SHARE YOUR PERSONAL INFORMATION
WITH ADVERTISERS, DATA BROKERS, OR THIRD-PARTY MARKETING COMPANIES

Your data stays private. Period.

Service Authorization

By requesting service, the customer authorizes Spectre Computer Repair to:

  • Diagnose hardware and software problems
  • Perform hardware repairs and maintenance
  • Replace defective components when approved
  • Install software updates or drivers when necessary
  • Conduct troubleshooting and testing procedures
  • Access systems and device settings necessary to complete repairs
  • Communicate service updates through SMS, email, phone, or customer portal systems

All major repairs, additional labor charges, or replacement parts requiring costs beyond the original estimate require customer authorization unless otherwise approved in writing.

Estimates & Diagnostic Services

Repair estimates are based upon initial inspections and diagnostic findings. Additional issues discovered during repair procedures may result in revised estimates or additional repair recommendations.

Diagnostic fees:

  • May apply regardless of whether repair service is approved
  • Cover technician labor, testing, troubleshooting, and evaluation procedures
  • Are non-refundable once diagnostic work has begun

Spectre Computer Repair will make reasonable attempts to contact customers regarding revised estimates, additional repair needs, or newly discovered hardware or software failures.

Payment Terms & Unclaimed Property

Payment is due immediately upon completion of services unless prior payment arrangements have been approved in writing by Spectre Computer Repair.

Accepted payment methods may include:

  • Credit cards
  • Debit cards
  • Cash
  • Mobile payment services
  • Secure online payment systems

Failure to complete payment may result in delayed release of repaired devices, additional storage fees, collection actions, lien enforcement procedures, or other remedies permitted under applicable West Virginia law.

Pursuant to West Virginia Code §38-11-3 and §38-11-14, Spectre Computer Repair maintains a possessory lien on devices, equipment, accessories, and related property for unpaid repair, labor, diagnostic, storage, or service charges.

Spectre Computer Repair reserves the right to retain possession of any device, equipment, accessories, or related property until all balances, storage fees, service charges, and outstanding invoices have been paid in full.

Devices, equipment, accessories, or other property left unclaimed for more than ninety (90) days after:

  • Repair completion,
  • Customer notification,
  • Failed pickup attempts,
  • Failed delivery attempts, or
  • Final service communication

may be considered abandoned property where permitted by law.

Abandoned or forfeited property may be subject to:

  • Permanent forfeiture of ownership rights
  • Resale to recover unpaid balances or storage fees
  • Recycling or disposal
  • Liquidation of unclaimed inventory
  • Collection actions or legal enforcement proceedings

Reasonable attempts may be made to contact customers using the information provided during check-in; however, Spectre Computer Repair is not responsible for failed communications caused by inaccurate, outdated, blocked, disconnected, or inactive customer contact information.

By submitting a device for service, the customer acknowledges and agrees:

  • Spectre Computer Repair may retain possession of property for unpaid balances under applicable West Virginia lien laws;
  • Unclaimed devices remaining beyond ninety (90) days may be considered abandoned or forfeited property;
  • Spectre Computer Repair may lawfully dispose of, recycle, liquidate, or resell abandoned property to recover costs where permitted by law.

Customers are strongly encouraged to retrieve completed devices promptly after notification to avoid additional fees, forfeiture actions, or disposal procedures.

Payment Security & Encryption

All payment transactions processed through Spectre Computer Repair are protected using advanced encryption technologies and modern cybersecurity standards.

We utilize secure encrypted payment gateways and industry-standard cryptographic protocols designed to help protect customer financial information during processing and transmission. Sensitive payment data is secured using modern encryption methods, tokenization systems, secure authentication controls, and advanced cybersecurity protections intended to reduce the risk of unauthorized access, interception, fraud, or data theft.

Security protections may include:

  • SSL/TLS encrypted payment sessions
  • PCI-compliant payment processors

Spectre Computer Repair does not store full credit card or debit card numbers on local company systems or repair databases.

Data Backup & Customer Responsibility

Customers are solely responsible for backing up all important files, software, passwords, applications, licenses, documents, videos, photos, and personal data before service begins.

While reasonable care is taken during repair procedures, Spectre Computer Repair is not responsible for:

  • Data loss
  • Corrupted files
  • Software corruption
  • Operating system failures
  • Encryption failures
  • Hardware failures occurring during repair
  • Pre-existing drive damage
  • Malware infections
  • Data recovery failures

Customers acknowledge that electronic repairs inherently carry some risk of partial or complete data loss.

Passwords & Device Access

Customers may be required to provide passwords, passcodes, PINs, administrator credentials, or security access necessary for diagnostics and repairs.

Failure to provide necessary access credentials may:

  • Delay repair services
  • Limit diagnostic capabilities
  • Prevent completion of repairs

Spectre Computer Repair maintains strict confidentiality regarding customer credentials and account access information.

Device Privacy & Confidentiality

Spectre Computer Repair respects customer privacy and digital confidentiality.

Technicians access only the files, applications, accounts, or system areas reasonably necessary to diagnose or repair reported issues. We do not intentionally access, copy, distribute, or disclose personal files unrelated to requested services.

Customers are encouraged to remove sensitive information whenever possible before submitting devices for repair.

Illegal Activity & Prohibited Content

Spectre Computer Repair reserves the right to refuse service, terminate repairs, suspend accounts, or report illegal activity discovered during diagnostics, inspections, or repair procedures.

Any evidence of unlawful activity may be documented and automatically reported to local, state, or federal law enforcement authorities where required by law.

Prohibited activity includes, but is not limited to:

  • Malware deployment
  • Unauthorized hacking activity
  • Identity theft
  • Fraudulent payment activity
  • Cybercrime activity
  • Possession or distribution of illegal digital material
  • Device tampering related to criminal conduct
  • Stolen or blacklisted devices
  • Unauthorized access attempts
  • Software piracy or malicious software distribution

Spectre Computer Repair fully cooperates with lawful investigations involving criminal activity, cybersecurity threats, or threats to public safety.

Repair Completion & Storage

Customers are responsible for retrieving completed devices promptly after repair completion notifications are issued.

Storage fees may apply to devices not retrieved within a reasonable timeframe following repair completion.

Devices left unclaimed beyond ninety (90) days may be classified as abandoned property and handled in accordance with applicable West Virginia laws and company policies.

Warranty Disclaimer

Unless otherwise stated in writing:

  • Repairs are provided "as is"
  • No guarantee is made regarding future hardware reliability
  • Pre-existing conditions may affect repair outcomes
  • Software compatibility issues may occur following repairs

Limited warranties may apply only to specific replacement parts or services directly provided by Spectre Computer Repair.

Warranty coverage does not apply to:

  • Physical damage
  • Liquid damage
  • Malware infections after service
  • User-caused damage
  • Unauthorized modifications
  • Electrical surges
  • Environmental damage
  • Third-party repair attempts

Limitation of Liability

To the fullest extent permitted by law, Spectre Computer Repair shall not be liable for:

  • Data loss
  • Business interruption
  • Loss of profits
  • Indirect damages
  • Consequential damages
  • Cybersecurity incidents outside our reasonable control
  • Pre-existing hardware or software defects
  • Device manufacturer defects
  • Lost productivity or commercial losses

Maximum liability for any claim related to services provided shall not exceed the total amount paid for the specific repair service giving rise to the claim.

Website, Software & Customer Portal Usage

Customers using our website, repair tracking systems, customer portals, software tools, or communication platforms agree not to:

  • Attempt unauthorized access
  • Upload malicious software
  • Interfere with website or portal operations
  • Abuse notification systems
  • Conduct cybersecurity attacks
  • Scrape or exploit company systems
  • Reverse engineer software systems
  • Attempt to compromise encryption or security protections

Unauthorized use of company systems may result in:

  • Account termination
  • Service denial
  • Permanent bans
  • Legal action
  • Criminal reporting

SMS, Email & Electronic Communications

By providing contact information, customers consent to receive:

  • Repair status updates
  • Appointment reminders
  • Pickup notifications
  • Billing notices
  • Security verification messages
  • Service announcements

Standard carrier messaging and data rates may apply.

Customers may opt out of non-essential promotional communications at any time.

Force Majeure

Spectre Computer Repair shall not be held liable for delays, failures, or damages caused by events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Power outages
  • Cyberattacks
  • Internet failures
  • Supply chain disruptions
  • Government actions
  • Severe weather
  • Hardware manufacturer delays

Changes To Terms

Spectre Computer Repair reserves the right to modify or update these Terms of Service at any time without prior notice.

Updated versions will be posted on our website with revised effective dates. Continued use of services constitutes acceptance of revised terms.

Governing Law

These Terms of Service shall be governed by applicable local, state, and federal laws, including the laws of the State of West Virginia.

Any disputes arising from services provided by Spectre Computer Repair shall be handled within the appropriate legal jurisdiction where the business operates.
