User Agreement
By using Planet-Hosts Hosting services or services provided from this web site, You HAVE AGREED TO THIS ACCEPTABLE USE POLICY outlined below. You HAVE also AGREED TO COMPLY with our (TOS) TERMS OF SERVICE Planet-Hosts Hosting reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service). All users of Planet-Hosts Hosting Internet services, and their clients, must comply with this AUP and our TOS (Terms of Service).
IMPORTANT NOTICE:
Please familiarize yourself with all terms of our services We support the uncensored flow of information and ideas over the Internet and do not actively monitor subscriber activity under normal circumstances. Similarly, we do not exercise editorial control over the content of any web site, e-mail transmission, newsgroups, or other material created or accessible over or through the services, except for certain proprietary Web sites. However, in accordance with our TOS (Terms of Service), we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. Planet-Hosts may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing. Your violation of this AUP may result in the suspension or immediate termination of either your Planet-Hosts hosting account or other actions as detailed below without notice, based upon the nature of the violation.
Adult hosting is OK. Hosting only Customers: Please remember, your unlimited E-Mail Services, domains and/or sub domains are for YOUR use. They are not intended to be used for re-sale, promotional offerings or any other type of distribution. Any email, domain or sub domain service being abused may be grounds for account termination or suspension without refund at Planet-Hosts discretion.
Usage of Server Resources:
Customer agrees that Customer shall not use excessive amounts of server resources (such as, but not limited to, CPU time & memory usage) on any of Planet-Hosts servers. Any violation of this policy may result in corrective action by Planet-Hosts including assessment of additional charges, disconnection or discontinuance of any and all Services, or termination of this Agreement, which actions may be taken in Planet-Hosts sole and absolute discretion. If Planet-Hosts takes any corrective action under this section, Customer shall not be entitled to a refund of any fees paid in advance prior to such action. This document is intended to provide a basic understand of Planet-Hosts Acceptable Use Policy. The following are guidelines for the establishment and enforcement of Planet-Hosts AUP. If a Planet-Hosts account violates this Acceptable Use Policy or our TOS, we reserve the right to terminate your service without notice. We prefer to advise customers of inappropriate behavior and any necessary corrective action, however based on the nature of the violation, could result in immediate termination of service.
The following Constitute Violations Of This AUP:
Illegal Activities:
Planet-Hosts Hosting services may not be used for illegal purposes, or in support of illegal activities. Planet-Hosts reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. Harm or Endangerment to other people: You may not use Planet-Hosts service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography, or use Planet-Hosts service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous emailers or nicknames does not constitute impersonation. Unsolicited E-mail, News Bombing
SPAM:
Use of the Planet-Hosts Hosting service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate suspension of the offending Planet-Hosts account. Spam complaints will be sent to the e-mail address on file. Failure to respond to complaints within a 24 hour timeframe will result in the Planet-Hosts staff suspending the offending account by whatever means necessary. Should the account become re-activated without the express written consent of Planet-Hosts, the offending account will be immediately terminated, and may result in suspension / termination of the server itself. Anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been completely removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation will be immediately and permanently removed from our network without notice. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending Planet-Hosts account.
Planet-Hosts fully supports Double opt-in safe lists as long as they are on their own dedicated servers. These types of sites use a great deal of resources and can't be supported through our website or reseller programs. We also require that these list be carefully policed and comply with all state (Maine) and federal (United States) law (regardless of where the site are located). Failure to abide by these laws constitutes spamming and will be subject to our spamming policy. Please review it below, it is quite severe and will be enforced without exception or limits. Copyright or trademark infringement: Use of the Planet-Hosts service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
Use of the Planet-Hosts service to collect, or attempt to collect, personal information about third parties without their knowledge or consent. Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. Network disruptions : Use of the Planet-Hosts Hosting service for any activity which affects the ability of other people or systems to use Planet-Hosts Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited.
Planet-Hosts will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data. Planet-Hosts, does not allow the hosting of IRC, IRC Bots, or egg drops or Unauthorized SHELL programs on our network. Accounts found hosting this material will be subject to immediate cancellation without refund.
Use of the Planet-Hosts service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Planet-Hosts or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Planet-Hosts account is subject to immediate termination.
ALLOWED SITES:
Adult sites are allowed to be hosted on our servers, as long as the models displayed are at least 18 years or older. The adult sites must be in compliance with all governing laws of US regarding pornography. High Loads of streaming contents are not allowed on any site, unless you have a dedicated server. The website cannot attempt to download any virus or malicious or annoying files when opened. IRC bots, programs, or networks of any kind are not allowed. If an IRC program is discovered, immediate termination will result without warning. The following processes are illegal on our servers and will be killed automatically: BitchX, bnc, egg drop, guard services, ircd, psyBNC, ptlink, services. Websites with processes that consume or take the server load to an unmanageable level will have that process terminated immediately - this includes the use of VI Edit or VIM.
If these processes continue to operate or cannot be found after termination of process will result in the website's) being disabled and/or terminated from the server. Please use PICO for file edits. Accounts granted SSH access that are found to have processes running in this same manner will have SSH access deactivated for a minimum of 6 months.
Intellectual Images videos and consent:
Adult sites promoting sex in the form of images and or video feeds must obtain and retain all release forms and provide them to there sales rep. this includes all a copy of there models drivers license .Intellectual consent all adult websites must provide Intellectual consent all complaint filed must be filed within our abuse department. Adult sites hosting images and or videos unapproved are a subject to a strict violation of all ( ADULT TOS ) rules. Any account found to violate the Intellectual consent rules are subject to a clean up fee ($50.00 an hour ) if the site owner fails to remove images within 24hrs of the first notice
if the site owner repeats this offence there website will be scheduled for a board review by the ( Hosting Provider ) the review will therefore decide the state of the customer as a security , Identity , Slander risk those who break these defined rules are still under a contract and will be held liable to render there services as Canceled and or Suspended and can not forfeit any contracted payments for the term of the hosting and are subject to another board review
Unlimited Accounts:
Disk space and bandwidth are Unmetered, and hosted domains allowed is also unlimited on this hosting plan. Use what you need as long as it does not have a negative impact on the server or on other accounts. Accounts considered to be abusing the server, overloading the server or violating any of our terms will be removed without a refund. Free web hosting We do not offer free web hosting at this time. Resellers are not allowed to offer Free web hosting under no circumstances. If you lease a dedicated server, you may do so as you please since you'll have complete control on that server. Offering a free trial period is OK and is not considered as free hosting.
Security:
You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server.
Network Security:
Planet-Hosts Hosting accounts operate on shared network resources. Excessive use or abuse of these resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination of your account. REPORTING VIOLATIONS OF Planet-Hosts AUP Planet-Hosts requests that anyone who believes that there is a violation of this AUP direct the information to the Abuse Department at abuse@planet-hosts.com if possible, please provide the IP address used to commit the violation, date and time of the violation, and evidence of the violation.
Planet-Hosts will charge a $50.00 site clean-up fee for any abuse of the terms listed above PLUS, ALL TIME AND RESOURCES TO TRACK AND TRACE ABUSE WILL BE BILLED AT PLANET-HOSTS $35.00 PER HOUR. SUSPENSION AND TERMINATION We take these terms very seriously. If an account is found to be violating one or more of the above terms, that account will be immediately suspended or permanently terminated. We may issue a final warning at our sole discretion and reinstate an account on a case by case basis. There will be reconnection fee of $20.00. We charge this fee to prevent future violations all accounts found in violation will then be offered there accounts back on a month to month monitored basis to assure quality hosting and less a TOS violated environment.
